Procedural time limit (Code of Civil Procedure)

The due date of a procedural term — an appeal, a procedural document, a statement of defence. The rule in art. 181(1)(2) of the Code of Civil Procedure, „in clear days": neither the day the term starts running nor the day of expiry counts. A 7-day term from 1 March expires on 9 March.

For civil (contractual) terms the rule is different, by one day: see /termen/civil.

How it behaves

  • The due date of a procedural time limit: appeal, statement of defence, procedural act.
  • The rule (art. 181(1)(2) of the Code of Civil Procedure), "clear days": neither the day from which the term runs NOR the day of expiry is counted. An act served on 1 March with a 7-day term expires on 9 March.
  • For CIVIL (contractual) time limits the rule is different and the result differs by one day — see /termen/civil. The same starting date and the same number of days produce different due dates; picking the wrong route means, for an appeal, the difference between "filed in time" and "out of time".
  • The difference is insidious for CALENDAR terms: the two conventions often coincide, because the extra day is absorbed by the weekend, and they differ visibly only when that extra day falls Monday to Friday. A result that is correct nine times out of ten stops being checked by anyone.
  • If the due date falls on a non-working day, it is extended to the first working day (art. 181(2) of the Code of Civil Procedure). The extension is the rule, not an option — the raw due date stays in data_inainte_de_prelungire.
  • Mind the cut-off hour: art. 182 provides that a term counted in days expires at the hour the court ceases activity, not at midnight. This route returns the day, not the hour.
  • sector=public also accounts for bridge days set by Government decision.
  • The result is a calendar computation, not legal advice: an applicable special law may provide a different counting rule.

What it is for

  • The deadline for filing an appeal.
  • The deadline for filing a statement of defence.
  • Checking whether a procedural act was done in time.
