Statutory interest, general regime

The statutory remuneratory and penalty interest under Government Ordinance 13/2011, with the variants reduced by 20% for relations not arising from the operation of a for-profit undertaking.

Here the reference rate follows the NBR decisions and applies immediately. For relations between professionals the rule is different — the rate is anchored to the first day of the half-year: /dobanda-legala/profesionisti.

How it behaves

  • The level of statutory remuneratory and penalty interest under Government Ordinance 13/2011, on a date.
  • Art. 3(1): remuneratory = the reference rate. Art. 3(2): penalty = reference + 4 percentage points. Art. 3(3): in relations not arising from the operation of a for-profit undertaking, both are reduced by 20% — which is why the response carries all four, with no parameter: they derive from the same rate, and a switch would be redundant.
